OGB Censure, Suspension and Expulsion Process

Censure, Suspension and Expulsion policy/procedures

This is a process and procedures document that is referenced by the OpenSolaris Constitution, version 2.0 It is maintained by the OGB, and is expected to evolve as needed to meet the needs of the community.

If outright abuse by a Community Participant is reported to the OGB, the situation will be reviewed in the following way:

  • The OGB (Secretary if available, otherwise other member) will notify the individual that his or her participation in the community is under review and that the review will be completed within thirty days.
  • This review shall occur in a closed session and remain private.
  • At its absolute discretion, the OGB may place the participant on "administrative leave", and temporarily revoke privileges granted as part of any Contributorship (such as write access to community infrastructure) until this review is complete.
  • This closed review will result in one of the following actions:
    1. Take no action
      • Any "administrative leave" actions are reversed,
      • The participant is notified that the review has been completed, and that the result is that the Board decided to take no action,
      • No public report is expected or should be given.
    2. Censure
      • Censure is a procedure for publicly reprimanding someone for inappropriate behavior. When an OpenSolaris Participant is censured, it serves merely as a condemnation and has no direct effect on the participant's contributions or privileges, nor are there any other particular consequences.
      • A resolution of censure is drafted in closed session, and is reported out as specified by Policy on private OGB discussions.
      • The participant is notified that the review has been completed, and that the result is the resolution that will be discussed and voted on.
      • If a resolution of censure is passed by a majority of the Board in an open OGB meeting, the participant
        • will be sent the text of the censure.
      • Any "administrative leave" actions are reversed
    3. Suspension
      • If the participant has previously been suspended, the OGB may recommend expulsion.
      • A resolution of suspension (including the term of suspension, up to 6 (six) months) is drafted in closed session, and is reported out as specified by Policy on private OGB discussions.
      • The participant is notified that the review has been completed, and that the result is the resolution that will be discussed and voted on.
      • If a resolution of suspension is passed by a majority of the Board in an open OGB meeting, the participant
        • will be sent the text of the suspension resolution,
        • will be excluded from Membership in the Electorate,
        • may not vote in Annual Elections or Special Elections, and
        • will not be counted when determining the number of members needed or participating for determinations of quorum,
        • will have all Leadership roles in OpenSolaris Groups revoked,
        • will have all privileges granted as part of any Contributorship (such as write access to community infrastructure) revoked.
      • These actions will be reversed after the period of time stated in the resolution.
    4. Expulsion
      • A resolution of expulsion is drafted in closed session, and is reported out as specified by Policy on private OGB discussions.
      • The participant is notified that the review has been completed, and that the result is the resolution that will be discussed and voted on.
      • If a resolution of expulsion is passed by a two-thirds majority of the Board in an open OGB meeting, the participant
        • will be sent the text of the expulsion resolution,
        • will be excluded from Membership in the Electorate,
        • may not vote in Annual Elections or Special Elections, and
        • will not be counted when determining the number of members needed or participating for determinations of quorum,
        • will have all Leadership roles in OpenSolaris Groups revoked,
        • will have all privileges granted as part of any Contributorship (such as write access to community infrastructure) revoked,
        • will have email and forum posting privileges revoked.
      • These actions are permanent.

Notwithstanding any above actions, a subsequent act of the Members in a Special or Annual Election may revoke an expulsion or suspension.
